After threats of jail time, removal, Otero County certifies primary election results

On Friday, the Otero County Commission met in the capacity of the county’s Canvass Board to certify the results of the 2022 Primary Election. The emergency meeting announced Thursday afternoon happened after Democrat New Mexico Secretary of State Maggie Toulouse Oliver took the commissioners to the state Supreme Court to compel them to certify, which it did.

Toulouse Oliver also sent a criminal referral to New Mexico Attorney General Hector Balderas, who would pursue legal action against the commissioners resulting in felony charges and potential removal from office.

During the meeting, Commissioner Vickie Marquardt, the chairwoman of the Commission, said the state was forcing the commissioners to be “rubber-stamping this” certification or else she and the others would be jailed.

“I will be of no use if I am in jail,” said Marquardt, stating how the state law gives County Commissions no power to object to election results even if there are issues found.

“I just want the election to be a trustworthy election,” Marquardt said.

Marquardt urged citizens to “reach out to the Legislature” to get the law changed.

Commissioner Gerald Matherly, who preciously had concerns regarding people voting from specific addresses, noted how Otero County Clerk Robyn Holmes helped him work through his concerns. He noted how since there were “no proven black and white facts” to prove fraud, there was no real recourse against the state.

Holmes insisted the County Clerk’s Office “crossed every I and dotted every t.”

Commissioner Couy Griffin, the only dissenting vote to the canvass who attended via telephone since he was in Washington, D.C., said, “All we wanted to do was to look inside the machines,” adding, “we wanted to hand-count the ballots.”

Griffin was in court today to be sentenced for his participation in the rally at the U.S. Capitol on January 6, 2021, where Griffin led a crowd in prayer. He was convicted of trespassing, which resulted in 14 days in jail (time served), a $3,000 fine, 60 hours of community service, and a year of supervised release, according to CBS News.

“We really need to wake up to the overreach of the state government,” Griffin added. “If this is as far as our audit goes … it’s enough to prove how scared they are at the top.”

Marquardt reaffirmed that she could do “a lot more good in our seat[s]” fighting for the ranchers of the county and other issues than if Democrat Gov. Michelle Lujan Grisham would be allowed to replace the commissioners with her hand-picked replacements.

“We honestly don’t have a choice,” Marquardt said.

The final vote was 2-1, with Marquardt and Matherly voting to approve the canvass of the election while Griffin voted against certification. Watch the recording of the meeting here:

Following the certification meeting, Toulouse Oliver released the following statement:

“I am relieved that the Otero County Commission finally did the right thing and followed their duty under New Mexico law to certify the free and fair results of the 2022 Primary Election. The voters of Otero County and the candidates who duly won their primaries can now rest assured that their voices have been heard and the General Election can proceed as planned.”

SOS Toulouse Oliver raising campaign cash off of lawsuit against Otero County

On Wednesday, following a lawsuit filed in the New Mexico Supreme Court to force Otero County to certify the 2022 Primary Election despite concerns, Secretary of State Maggie Toulouse Oliver appeared on multiple left-wing cable news channels to attempt to make an example out of the County.

She even threatened the possibility of a criminal referral to the state Attorney General demanding prosecution and removal of the three Republican county commissioners who did not certify the election. The Court ruled the same day that the County Commission must certify the election.

On Thursday, however, Toulouse Oliver showed a likely hidden agenda in the media stunt. She sent out an email to her campaign supporters asking for money following her lawsuit against Otero County.

She wrote in the email, “This week, all three Otero County Commissioners refused to certify the results of our Primary Election because they don’t ‘feel in their heart’ that the results are correct.

“If these votes aren’t certified, all votes in the county would be thrown out. They would disenfranchise every single voter in Otero – a county that went 62% to Trump – because they don’t feel the voting machines are accurate.”

She then added, “Not on my watch…. I’m suing the Otero County Commissioners to demand they follow the law and certify the election.”

Toulouse Oliver then asked for money from supporters since she claims she’s “fight[ing] against the conspiracy theories and lawlessness trying to dismantle our democracy.”

“I like to think that the county commissioners who have sworn an oath to the Constitution will do the right thing. But I’m concerned that this idea could set a precedent and spread not only in NM, but across the country,” she added.

However, in state statute, the commissioners are not mandated to certify the results if they find a discrepancy. The Otero County Commission is meeting on Friday at 4:00 p.m. to discuss the canvassing of the election.

SOS Toulouse Oliver wants to remove Otero Commissioners, throw them in jail

On Wednesday, far-left Secretary of State Maggie Toulouse Oliver appeared on at least two programs on CNN and MSNBC to discuss her legal actions taken against the Otero County Commission, which refused to certify the June 7, 2022, Primary Election.

While speaking with MSNBC’s Rachel Maddow, Toulouse Oliver disclosed that she will be making a referral to the New Mexico Attorney General’s Office recommending the removal and prosecution of the three members who unanimously voted against certification.

Toulouse Oliver said, “We’re going to be making that referral shortly, and quite frankly, criminal prosecution is on the list, as well as removal from office for these commissioners who are violating the law.” 

Although the three commissioners did not list a specific instance of potential fraud, they did claim that they had concerns regarding voters being incorrectly registered and potential issues with Dominion tabulator machines.

On Wednesday, the state Supreme Court ordered them to certify the election results by Friday. It is unlikely that will happen since the Commission’s chairwoman, Vickie Marquardt, said she would be in Santa Fe at a meeting, while Commissioner Gerald Matherly would be out of town, and Commissioner Couy Griffin has already left the state for Washington, D.C. to attend sentencing hearings of fellow January 6 defendants.

SOS Toulouse Oliver sues Otero County, threatens criminal referral to AG

On Monday, Otero County’s three-member commission refused to certify the canvass of last Tuesday’s primary election. The Commission cited no specific abnormalities but generally listed fraud related to Dominion machines as one of its reasons. The Commission also did not request to bring in members of the county canvass board to address specific concerns.

After the unsuccessful canvass, state Sen. Daniel Ivey-Soto (D-Bernalillo), an attorney who lists himself as “Executive Director for New Mexico’s County Clerks” sent a threatening email to county commissioners across the state demanding they certify the election. Friday, June 17, is the deadline to certify the results of the canvass, per state statute, which cites ten days following the election.

He wrote:

“If Friday comes and goes and a County Canvassing Board hasn’t acted to approve the County Canvass Report, then has  County Canvassing Board is subject to a mandamus action. The standard for the mandamus action is if the Bard l as a clear and unambiguous duty, which I read in the election Code that they do. If, after a District Judge orders the Board to approve the County Canvass Report, then the Board would be in contempt of Court and the Judge would decide what to do with them (fines, loss of freedom, removal from office, etc…). We hope we don’t get to that point.” 

According to election integrity expert David Clements, New Mexico’s Dominion machine software is out of compliance with state statute, therefore triggering his call for county commissions not to approve the June 7, 2022, Primary Election results. Ivey-Soto refutes that in his email to commissioners, claiming they are certified.

Clements wrote regarding Ivey-Soto on Facebook, “According to an Ethics Complaint, Dominion’s favorite NM legislator, Senator Daniel Ivey-Soto, is the Executive Director of Vandelay Solutions, which provides ‘professional services’ in the administration of elections. His company entered into two contracts with Dona Ana County, for ‘Consulting Services’ and ‘Technical Assistance’ between September 2019 and June 2021 for  $37,500 and $45,000.  How is this not a conflict of interest?” Clements has branded Ivey-Soto as “Dominion’s favorite legislator” and noted his connections are a “conflict of interest.”

Then on Tuesday, Democrat Secretary of State Maggie Toulouse Oliver filed a lawsuit in the state Supreme Court against Otero County “seeking to compel the Otero County Commission to certify the 2022 Primary Election results.”

Toulouse Oliver claims, “New Mexico’s 2022 Primary Election was conducted with the highest standards of election administration by dedicated county clerks and civil servants across our state.” She added, “The post-election canvassing process is a key component of how we maintain our high levels of election integrity in New Mexico and the Otero County Commission is flaunting that process by appeasing unfounded conspiracy theories and potentially nullifying the votes of every Otero County voter who participated in the Primary.” 

A press release from Toulouse Oliver’s office noted in addition to the lawsuit to compel the Otero County Commission’s compliance with the state elections code “[b]ecause of these violations of their oaths, the Secretary of State’s Office is also preparing a criminal referral to the New Mexico Attorney General related to these willful violations of the Election Code by county officers and their willful failure or refusal to perform their duties under the Election Code.” As of the date of the lawsuit, 12 of New Mexico’s 33 counties had successfully canvassed their election results.

Following this news, Clements said in a recorded video that Toulouse Oliver’s lawsuit is saying, “the commissioners only have one power, and that’s to approve the results, no matter what their concerns are. It’s a gross misreading of the statutory authority of the Otero County Commission.” 

“The Secretary of State is effectively going to the Supreme Court demanding a writ of mandamus — basically saying, ‘Court, order them to certify the election even though the election is being held on uncertifiable, illegal voting systems,’ — which raises the question, why aren’t the county attorneys filing an emergency writ of mandamus with the Supreme Court demanding that the Secretary of State decertify use of the machines, consistent with the statute?”

Clements is urging citizens to look up their county commissioners and ask them not to certify the June 7, 2022, Primary Election. 

The actions by certain county commissions could delay the certification of primary election winners, while the Secretary of State Toulouse Oliver even claims in its lawsuit that refusal to certify “jeopardizes the general election ballot for all candidates.” 

It is immediately unclear what the Otero County Commission will do in response to the lawsuit, but it would have until Friday to comply with the Secretary of State’s demands, or else the state Supreme Court is likely to take action.

Toulouse Oliver spreads election lies with so-called ‘Rumor vs. Reality’ site

On Tuesday, it was reported that far-left Democrat Secretary of State Maggie Toulouse Oliver was launching a new so-called “Rumor vs. Reality” page on the official Secretary of State website claiming to debunk falsehoods regarding elections.

Toulouse Oliver erroneously tries to falsely claim that the Dinesh D’Souza film, 2000 Mules, incorrectly describes ballot trafficking across the country. She claims, “The movie uses flawed assumptions and faulty data to try to prove its point about the 2020 election.”

She uses the false talking point that the 2020 election, which the 2000 Mules movie and multiple other data sources have debunked, “was the ‘most secure in history.” 

The Democrat Secretary of State also claimed that New Mexico’s voter rolls are “clean and up-to-date,” which is also a false statement. Despite the audit of the 2020 election in Otero County proving that 40% of ballots cast in 2020 had anomalies, she claims she has faith in Electronic Registration Information Center (ERIC). She claims the platform “uses information from motor vehicle departments, Social Security Administration records, and other databases to compare voters across all member states and securely shares this information with member states.”

ERIC was founded by the leftist Pew Charitable Trusts. 

Another false claim Toulouse Oliver makes is that vote tabulators are not connected to the internet, despite Otero County audit findings showing that is false. Toulouse Oliver claimed, “vote tabulators are prevented by law and process from being joined to a computer network or the Internet.”

Despite her claims, all three major vote tabulator manufacturers “have acknowledged they all put modems in some of their tabulators and scanners,” according to NBC News

Toulouse Oliver claimed that election results cannot be changed, citing so-called “safeguards,” such as risk-limiting audits that do not truly audit findings from an election. Also, since each individual absentee ballot, once separated from its enclosing envelope, is undetectable as a unique ballot tied to a specific voter. Therefore there is no way to claim with such certainty, as Toulouse Oliver does, that “safeguards” keep elections from being stolen.

There are other various claims the Secretary of State makes which are blatantly false. She appears to be using the official Secretary of State’s Office website for political gain by lying about 2000 Mules and other truths proving election fraud exists — especially in the state of New Mexico.

Toulouse Oliver claims ‘conspiracists and extremists’ are ‘coming for our elections’

On Tuesday, the final day to raise cash in the fundraising quarter, far-left Democrat Secretary of State Maggie Toulouse Oliver sent out a paranoid-sounding email claiming, “[c]onspiracy theorists are coming for our elections.”

“Extremists who believe the Big Lie that the 2020 election was rigged and stolen are not just posting on Facebook or ranting at the dinner table. They are running for office. And they are coming straight for the seats that control our elections,” claimed Toulouse Oliver, alluding to her Republican challenger Audrey Trujillo.

Trujillo believes in election integrity and securing New Mexico’s elections after widespread voter fraud has been proven in multiple states in 2020 — enough to swing the election in President Trump’s favor. According to analysis from the movie “2000 Mules” by Dinesh D’Souza, even by conservative estimates, illicit ballot trafficking alone contributed far more fraudulent votes than needed to overturn the election.

“It is my job to preserve the sanctity of each and every vote in New Mexico. And I take that job very seriously,” claimed Toulouse Oliver, despite her repeated attempts to weaken New Mexico’s election laws by killing protections to voter integrity. These include trying to push for policies allowing ballots to be counted even if they arrive the Friday following an election, widespread ballot harvesting, and “drop-boxes,” which are used to traffick contraband ballots.

“Let’s be clear, Big Lie believers are running for Secretary of State to disintegrate our democracy from within. It’s up to us to protect it,” the Secretary of State continued. 

“New Mexico continues to be a leader in pro-democracy practices — even while states across the country and our national democracy are being threatened by conspiracists and extremists who simply don’t like the results of our free and fair elections.”

Toulouse Oliver plainly ignores the fraud in New Mexico elections, which has been well-documented by the Piñon Post, and instead bashes anyone who disagrees with her assessment that her election system is “pro-democracy” or “free and fair” as “conspiracists and extremists.”

Audrey Trujillo is a true hero for New Mexico

After the 2020 Presidential Election, many Americans across the country felt that their vote didn’t count. Many voters believe that the election was stolen and the confidence in our electoral process was no longer there. Why is that? We have seen election rules meant to secure the electoral process loosened prior to an election, expanded usage of unsecured ballot drop boxes that have the potential to be ripe with fraud, unsolicited mail-in absentee ballots sent across the state in mass, weaponization of the voter laws and rules during the COVID-19 pandemic, voter rolls that haven’t been updated, and voting machines used to count ballots being compromised.

With all these irregularities, it’s no wonder why people believe we have predetermined selections, not fair elections. In New Mexico, the incumbent Secretary of State Maggie Toulouse Oliver is the one who administers and oversees the electoral process. Under her tenure, election integrity has been eroding away in the state of New Mexico. Maggie Toulouse Oliver claims that she has been upholding election integrity, but her actions show otherwise. For example, this year the state legislature failed to pass SB 144, an omnibus election bill. SB 144 started off as a page and a half.  Once she finished adding to it, SB 144 was now over 160 pages long.  This bill undermined our current election laws, and would open the door to potential fraud. She repeatedly referred to this legislation as “My bill”. 

Fortunately, when it went to the Senate, the Republicans were able to successfully kill the bill using the filibuster. On July 22nd, 2021, she held a hearing and implemented rules stripping mail-in ballot verification protections. This opened the door to potential fraud without consideration from the state legislature. These rules have had the same effect as if they were law, passed by the Legislature, and signed by the Governor. You have the inalienable right to vote, but you also have the right to know if your vote is being counted and the results will be fair.

Election integrity and voting rights are not supposed to be apolitical, but Maggie Toulouse Oliver has taken advantage of these very important issues for political gain. But there is hope for the future as Maggie Toulouse Oliver has opposition in November from a 15generational Hispanic woman who has been fighting for your constitutional rights for a very long time. That woman is Audrey Trujillo. Born and raised in New Mexico, Audrey Trujillo is a woman of integrity and honesty.

She has always been a mover and a shaker; from a young age, she was always at the forefront of any decisions that needed to be made. When politicians tried to take away your constitutional rights in Santa Fe, Audrey was there fighting for you. As your next Secretary of State, Audrey will bring back election integrity and transparency to New Mexico’s elections. She will clean up the voter rolls, implement measures to secure our elections, give each county clerk the tools necessary to protect their voter precincts from fraud, advocate for voter ID, and push for changes in the rules to limit absentee voting to only disabled, elderly, military and voters who are temporarily out of the state on business.

Our votes are sacred and need to be held to the highest standards. Under the administration of Audrey Trujillo, Every legal vote will be counted and every secure measure will be put in place to protect voter rights and integrity of the process. She is the right person for the job as Maggie Toulouse Oliver has tried to discredit her with false allegations. Recently, a slanderous hit piece from the Albuquerque Journal insinuated that Audrey Trujillo is a racist and anti-Semitic. Maggie Toulouse Oliver cited the article in a fundraising email.

Audrey is a 15 generational Hispanic woman born and raised in New Mexico with Jewish ancestry. Calling her a racist is abhorrent and ignorant. I’m a Black Puerto Rican American born and raised in New Mexico. I know Audrey and she’s not racist or anti-Semitic whatsoever. For Maggie Toulouse Oliver to use these lies defaming her character for campaign contributions is disgusting and despicable. Maggie Toulouse Oliver knows she’s not going to win and is playing dirty politics to derail Audrey’s grassroots campaign. Audrey is a True Hero for New Mexico and she will bring back honesty and integrity back to the office of the Secretary of State.

A vote for her is not only a vote for election integrity but for New Mexico’s future. The position of Secretary of State is the most important government position because it concerns our elections which are paramount to a free republic. Without the right to vote in free and fair elections, we have no country. In Audrey’s own words, “The citizens of New Mexico deserve free, fair, honest elections and that starts with a Secretary of State who believes in one vote per registered eligible voter.” If you believe in New Mexico, vote for a True Hero, and Audrey is that True Hero.

Maggie Toulouse Oliver, Hector Balderas sued in federal court

On Monday, election integrity watchdog Voter Reference Foundation (VRF)  filed a lawsuit against New Mexico Secretary of State Maggie Toulouse Oliver and Attorney General Hector Balderas to ensure the publication of the state’s voter rolls.

The suit was filed in ​​U.S. District Court in Albuquerque with the First Amendment being front and center in the complaint about the group’s right to publish the voter rolls for taxpayers to view.

VRF claims Toulouse Oliver falsely claimed in public statements that the group illegally published New Mexico’s voter rolls. She has a past of refusing to release voting records, as she did in 2017 when they were requested by President Donald J. Trump. 

“After VRF published the New Mexico voter roll in December, Oliver said it was illegal and referred the matter to Democratic Attorney General Hector Balderas for investigation and possible prosecution, according to a ProPublica article cited in the lawsuit,” Just The News reports.

“We are not going to be deterred by partisan election officials who believe the election records taxpayers pay for are their personal possessions,” said Doug Truax, Founder and President of Restoration Action, which started VRF. “The public has a right to see them and if they try to block us, we will assert that right in court.”

“The taxpayers of New Mexico pay for election administration, and they have an absolute right to view the records that are produced,” added Truax.

The lawsuit reads, “Because their First Amendment rights to use and disclose the voter data for purposes of encouraging voter participation and protecting election integrity are being chilled, Plaintiffs sue the Defendants in their official capacities to obtain a declaration that their conduct is lawful and to enjoin Defendants from enforcing any statute in violation of Plaintiffs’ rights.”

Toulouse Oliver campaign claims she’s ‘been upholding election integrity’

In a recent fundraising email, Secretary of State Maggie Toulouse Oliver’s campaign made an inaccurate claim that she “has been upholding election integrity since she took office.” This comes after she has repeatedly tried to unilaterally change the election code, which has forced the state Supreme Court to strike down her attempted changes.

Also, Toulouse Oliver backed multiple far-left proposals in the Legislature to remove integrity measures and let absentee ballots arrive the Friday after an election. That proposal also called for universal unsecured ballot drop boxes, ballot harvesting, and other measures that would have left New Mexico elections even more wrought with fraud.

But despite that, her campaign claims, “In one of the most vital election years on record, they say it’s all about election integrity for them, yet we’re not sure why because Maggie has been upholding election integrity since she took office. She intends to continue ensuring our elections are fair, free, safe, and secure when she wins reelection.”

Also, Toulouse Oliver’s campaign asserts it is “busy fending off attacks from far-right extremist billionaires with deep pockets claiming our election was a lie,” citing an unnamed “billionaire-backed dark money group.”

The comment reeks of irony as Toulouse Oliver has had the backing of far-left billionaire-backed dark money groups, including George Soros-funded pro-abortion EMILY’s List, Planned Parenthood Votes New Mexico, eco-Marxist “350” and the “Sierra Club,” among others.

The Secretary of State has weaponized her office throughout the years to go after political opponents, including her attempt to stop the Otero County audit of the 2020 election, which has already shown multiple abnormalities. She has worked in concert with Attorney General Hector Balderas and State Auditor Brian Colón to attempt to stop the county-sanctioned inquiry.

Toulouse Oliver attacks GOP opponent Audrey Trujillo

On Saturday, far-left New Mexico Secretary of State Maggie Toulouse Oliver’s campaign viciously bashed her GOP challenger, Audrey Trujillo in a fundraising email. The left-wing politician who does not believe election fraud exists and who has attempted to weaken the state’s election laws called Trujillo a “certified election denier.” 

In the email, the campaign wrote, “After being endorsed by the Trump-backed America First [SOS] Coalition and the MyPillow CEO Mike Lindell (yes, that guy), it’s clear that our opponent does not have New Mexicans’ democratic interests at heart.”

Trujillo is listed as a candidate on the “America First SOS Coalition” but a formal endorsement from Lindell cannot be found. 

“Our problem isn’t our election integrity process, but the actors creating doubt and mistrust in our elections that intimidate voters — and wasting taxpayer money to do so,” claimed Toulouse Oliver’s team. She added that “the stakes for our democracy could not be higher.”

This comes after Trujillo released a lengthy statement applauding the Otero County 2020 election audit and demanding answers as to why Toulouse Oliver and other Democrats are doing everything in their power to stop it. 

Trujillo wrote, “The latest Rasmussen poll shows that 83% of likely U.S. voters believe the issue of election integrity will be important ahead of this year’s elections. Of those respondents, a staggering 63% identified election integrity as a very important issue. Honesty, integrity, and transparency are instrumental to a free Constitutional Representative Republic.”

“Why all the attacks? Why all the smears? Why all the lies and disinformation? What is going [on] in Otero County is not about overturning the results or suppressing voters. It’s about transparency and addressing the concerns voters have about our electoral process. Right now, our elected officials are not being honest and transparent. No matter what your political affiliation is, these issues affect everyone and if we don’t properly address those issues, nothing is going to change for the better.”

But Toulouse Oliver is continuing to beat the “election denier” drum about Trujillo, despite the GOP candidate’s message of having free and fair elections in New Mexico without election fraud. 

Election fraud in New Mexico is well-documented and the Otero County audit has already begun finding concerning data regarding voter registrations. During the Piñon Post’s own independent findings in Otero County, many registered voters still on the rolls have been dead for at least five years, while many are registered at locations that do not have a residence on the property.
