NM House and Senate to hold final votes on abortion up-to-birth and infanticide bills

Today’s a deciding moment in New Mexico, with both the House and the Senate chambers to decide the fate of a radical abortion up-to-birth and infanticide bill, H.B. 7 in the House S.B. 10 in the Senate. Sens. Linda Lopez (D-Bernalillo) and Peter Wirth (D-Santa Fe) are sponsoring the legislation in the Senate and Reps. Micaela Cadena (D-Doña Ana), Brian Egolf (D-Santa Fe), Joanne Ferrary (D-Doña Ana), Deborah Armstrong (D-Bernalillo), and Georgene Louis (D-Bernalillo) are carrying the bill in the House. 

The bill would flatly strip away all protections on the books in New Mexico for women, children in the womb, and health care workers. The bill rips out portions of the law protecting medical professionals’ conscience rights, allows teen girls to get abortions on-demand with no parental consent, and paves a path for unregulated, unsafe abortions in New Mexico. 

The bill is an exact mirror image of 2019’s failed bill, which pro-life Democrats killed in the Senate. Since that vote, most of these pro-life members have been ousted by their parties or have mysteriously died. Gov. Lujan Grisham took out retribution on these pro-life Democrats by mounting well-funded primary challenges to them, made up of mostly out-of-state PACs, dark money organizations, and misinformation campaigns to malign their reputations. 

It should be noted that not a single co-sponsor of the radical abortion bills comes from any locality outside of the three Democrat-dominant population strongholds of Bernalillo, Doña Ana, and Santa Fe counties, which says a lot about where the bill comes from and where support for it comes from also.

Out-of-state abortion giants, including Planned Parenthood and far-left dark money group the American Civil Liberties Union, have spent an unknown sum on expensive mailers and digital advertisements on their deep-pocketed misinformation campaign. 

H.B. 7 and S.B. 10 were rushed through both chambers’ committees and both chambers will decide whether they support the right to life or abortion up-to-birth and infanticide.

Rogue NM Rep. Anderson votes against pro-life bill for COVID-19 safety standards at abortion facilities

On Wednesday, the House Health and Human Services Committee met to consider H.B. 160, a commonsense proposal to protect women during COVID-19 by implementing safety protocols at abortion clinics during the pandemic.

The proposal, sponsored by state Reps. Rebecca Dow (R-Grant, Hidalgo & Sierra), Rod Montoya (R-San Juan), James Strickler (R-San Juan), and Rep. Luis Terrazas (R-Doña Ana, Grant & Sierra) would require the New Mexico Department of Health to “establish and require specific health and safety protocols to be used at facilities at which abortions are performed to prevent the spread” of COVID-19 by July 1, 2021. 

The bill states, “The requirements shall include requirements for the use of personal protective equipment, capacity restrictions, enhanced screening procedures and self-isolation and self-quarantine for persons traveling into New Mexico from high-risk areas and low-risk areas.” 

“The requirements shall remain in effect as long as any public health order is in effect pursuant to the Public Health Act for the purpose of controlling or abating the coronavirus disease 2019.” 

However, Republican-turned “Declined to State” Rep. Phelps Anderson of Roswell voted with the seven radical Democrat members to kill the pro-life bill, making this the second anti-life vote he has made in the committee this legislative session. The final vote was 8-2, with pro-life Rep. Luis Terrazas (R-Doña Ana, Grant & Sierra) being excused for the vote.

Rep. Anderson previously voted for an abortion up-to-birth and infanticide bill peddled by pro-abortion groups Planned Parenthood, the ACLU, among other dark money organizations.

PETITION: Demand the resignation of Rep. Phelps Anderson for betraying his constituents

State Rep. Phelps Anderson (DTS-Roswell) was elected on a pro-life ticket as a Republican by the voters of New Mexico’s 66th District—which includes Roswell, a “sanctuary city for the unborn.” However, Anderson betrayed his constituents’ trust by voting for the abortion up-to-birth and infanticide bill, H.B. 7.

After massive backlash from his home district and across the state, he left the Republican Party in disgrace to become an Independent. He then on February 10 voted against a pro-life bill to protect women going to abortion facilities during COVID-19. On February 19, Anderson voted for the final passage of S.B. 10, abortion up-to-birth, and infanticide legalization.

But the people of the great 66th District did not elect an Independent—They elected someone they thought was a Republican. They also thought they were electing a pro-life representative, but now they are left without any representation at all.

However, Rep. Anderson doesn’t care. He callously told reporters, “Resignation is not a choice for me because I believe when an unpopular vote is made, we cannot expect our legislators to resign.” 

If Rep. Anderson refuses to resign and he continues to serve in the New Mexico House, the people of District 66 will be without representation for 23 months—equivalent to one year and 11 months.

Rep. Anderson’s betrayal should not be tolerated, which is why today, the Piñon Post is launching a petition demanding Rep. Anderson resign. 

As I said before, Rep. Anderson “must now resign and allow local leaders to fill his seat with someone who truly represents the 66th District. The time for wishy-washy and unreliable ‘Republicans’ in the House is over.”

Report: GOP rep. who voted for abortion up-to-birth and infanticide bill switches parties

The Piñon Post learned Friday that Republican Rep. Phelps Anderson (Chaves, Lea & Roosevelt) who voted for an abortion up-to-birth and infanticide bill in a Health and Human Services Committee hearing last week, changed his party affiliation to “Declined to State” after getting blowback.

Republican Leader Jim Townsend said, “I received a letter from him, and I have had a conversation with him, and he has left the Republican Party.”

The Santa Fe New Mexican reported that a text message from Anderson read, “Sorry,” adding, “Not today as I have done enough.”

During the committee hearing, Rep. Anderson claimed he understood concerns health care providers had about the bill regarding conscience rights, however, he voted to advance the measure anyway. 

After the vote, the Piñon Post send a letter asking the Republican Party leadership in the House of Representatives to hold a censure vote on Anderson by this Friday. However, that vote would no longer be necessary, now that Anderson has relinquished his affiliation with the Republican Party–a pro-life party. 

The renunciation by Rep. Anderson leaves his memberships on the Health and Appropriations & Finance committees in jeopardy, as the House Republicans will want Republicans on committees, especially influential committees like Appropriations and Finance.  

Rep. Anderson previously refused to comment on his vote, telling the Santa Fe New Mexican, “I think It’s best that I just leave that one alone now.”

The anti-life bill, H.B. 7, advanced from the Health and Human Services Committee on a vote of 8-3 and subsequently passed the House Judiciary Committee. It is unclear how Rep. Anderson will vote on the bill when it reaches the House floor.

Newly sworn-in NM rep. stands up for life in the womb

New Mexico Rep. T. Ryan Lane (R-San Juan) is brand new to the New Mexico Legislature, but he’s already ruffling some feathers on the left by standing by his convictions and boldly supporting human life in the womb.

In a video message tweeted out by the New Mexico House Republicans, Rep. Lane told New Mexico why he stands for life.

Here’s what he said: 

“I represent and stand for life because I care about the future of our state. I care about our future citizens who will be teachers, doctors, engineers, farmers, small business owners, and so many other things. And that future will never become a reality because they are not given an opportunity for life. Life is precious and I love all of it. That’s why I stand for life.”

The Farmington lawmaker wrote on his Facebook in a caption to the video, “Who knew that standing for life could be so controversial? Welcome to the Brave New World.”

Rep. Lane’s message comes as radical Democrats in the Legislature are working hard to ram through an abortion up-to-birth and infanticide bill that would strip away protections for babies in the womb, mothers, and health care providers. The Senate version of the bill passed through its last committee on Wednesday by a vote of 6-3 and it heads over to the Senate floor next.

Liberal columnist applauds state Rep. Anderson’s vote for abortion up-to-birth and infanticide

On Monday, liberal New Mexico paper, the Santa Fe New Mexican, applauded New Mexico state Rep. Phelps Anderson (R-Chaves, Lea, and Roosevelt) for his vote with Democrats in the House Health and Human Services Committee to approve an abortion up-to-birth and infanticide bill, H.B. 7, which would strip away critical life-saving protections for mothers, babies, and health care workers. 

Milan Simonich, the columnist who wrote the fluff piece, lauded Anderson as “reserved, courteous and almost averse to publicity.” 

When asking Anderson about his vote, which was a betrayal to the Republican Party, Anderson simply said, “I think it’s going to be best if I leave that alone.”

“[Anderson] displayed no rancor or even annoyance. He just didn’t want to talk about a decision that put him at odds with other Republicans and cast him in a harsh light on social media,” wrote Simonich.

He also lauded Anderson’s father, Robert Anderson, of which the University of New Mexico Anderson School of Business is named, and claimed Anderson is “independent” like his dad, who Simonich noted gave money from his oil fortune to support “environmental causes.” 

“Phelps Anderson might be independent enough to argue against an anti-abortion law that does nothing except take up space in the code book,” said Simonich, adding that Anderson may face opposition within the Republican Party. 

He concluded the article by noting how “polite” Anderson is, despite his vote with far-left Democrats for an abortion up-to-birth and infanticide bill. 

However, the people of Roswell, who are very pro-life, likely do not have the same admiration as Simonich for Anderson’s supposed “polite” demeanor. To many, the action by Anderson to vote in favor of such an anti-life bill is by no means “polite” or “courteous,” as the liberal Santa Fe newspaper columnist would like to portray him.

The Piñon Post has sent a letter to the Republican House leadership (Leader Jim Townsend (R-Artesia), Whip Rod Montoya (R-Farmington), and Caucus Chair Rebecca Dow (R-Truth or Consequences), requesting a caucus vote to censure Anderson for his anti-life action. The leaders have until Friday. February 5th, 2020 to hold the vote, or the Piñon Post will organize the tens of thousands of pro-life readers to demand Anderson’s resignation and recruit a strong primary challenger. 

Here is what Anderson said during the January 27, 2020 committee hearing, as he spoke to the bill’s sponsor, Rep. Joanne Ferrary (D-Doña Ana):

“It is of my belief that if this bill passes, nothing changes.”

“If nothing changes, why then did I in the last 24 to 48 hours receive literally thousands of forms of communication, largely urging a ‘no’ vote, but there were… there were… messages urging votes both ways. And I think, well… I read some of them and I think ‘well, this person is in for [a] disappointment because they’re urging a vote that is not going to affect what it is that concerns them in this message’ and that has given me a great deal of consternation about your bill, not because I—I’m just sort of thinking ‘what is it—what are we doing?’ Do we really have a bill here that really doesn’t do anything? Why not? Why not, Representative Ferrary?”

“Because in my opinion, Roe v. Wade made the 1969 New Mexico abortion law unconstitutional. So I think, ‘Okay, Representative Ferrary wants to repeal an unconstitutional law passed in the State of New Mexico fifty-two years ago more or less.’ And I find myself trying to say, ‘Now what part of that do I disagree with?’ I’m pro-life. I don’t—of many of the people who have spoken to me in the last day or two have expressed strong opinions and many of which I share. But I find myself at the end of this debate long day saying ‘I’m not sure that…voting yes or voting no changes anything—and that is very important to me in this vote—and secondly, I think the issues that have been raised are simply not encompassed within this vote.”

“So, with that, Representative Ferrary, I wanted to say the one thing that I appreciate your comment because the one thing I have heard today that I do think might change based on testimony is the conscience clause, and that will make a difference in how I vote on the House floor if go and believe that the conscience clause is not—is being removed. And I kinda think that I believe right now that that’s not what this repeal is doing, but I will—but we will see this bill again. With that, thank you, madame chairman, thank you Representative Ferrary.”

It should be noted that if the bill passes, life-saving protections, such as age restrictions for minors and conscience protections for health care workers will indeed be stripped, leaving an immediate impact on these groupswhich Anderson fails to recognize. Also, a doctor would not be required to perform an abortion, leaving women susceptible to sub-par care and a higher probability of being maimed or killed during the abortion. ‘Worse’ red-flag law proposed, anti-life bills to be heard Friday

The 2021 Legislative Session is in full-swing and here are some updates on some of the most divisive anti-gun and anti-life bills:

Anti-Gun Bills

On Thursday, it was revealed that far-left Democrat lawmakers in the New Mexico House of Representatives are looking to ram through even more divisive anti-gun legislation, this time in the form of an amended “red-flag” law, H.B. 193, which will make Michelle Lujan Grisham’s 2020 version of the bill signed into law even worse. 

According to the New Mexico Shooting Sports Association’s Zac Fort (NMSSA), the bill was proposed because Democrats became “frustrated that the initial law has hardly been used.” The bill would give the authority to a police officer to request an “extreme risk” red-flag order directly, further circumventing the process and making it easier to violate due process rights enshrined in the U.S. Constitution. Fort notes that “The order would allow the police officer to search the home of the defendant and seize any firearms the officer finds.” 

“The red-flag gun confiscation order has been a failure, as has every gun-control law passed in New Mexico. No one has been made safer, we only have fewer rights to show for it. Rather than making a bad thing worse, we need to repeal the red-flag law to protect New Mexicans civil liberties,” writes Fort. 

Another overtly anti-Second Amendment bill, H.B. 166, is also being considered, proposing bans on multiple types of firearms components and self-made firearms, turning owners of such firearms into felons. Anti-life bills

Also coming down the pipeline are two anti-life bills, H.B. 47 and H.B. 7. The first bill, H.B. 47, is an anti-life physician-assisted suicide bill that includes some horrifying language. The bill, sponsored by a far-left friend of Gov. Lujan Grisham, Rep. Deborah Armstrong (D-Bernalillo), alongside Senators Liz Stefanics (D-Santa Fe) and Bill O’Neill (D-Bernalillo), proposes a signed document where an individual requesting to have a medical professional help them kill themselves acknowledging the following:

“I understand the full import of this request, and I expect to die if I self-administer the medical aid in dying medication prescribed. I further understand that although most deaths occur within three hours, my death may take longer.”

The bill would dehumanize New Mexicans living with a terminal illness and leave them open to self-administering a fatal poison that could not only not work but could leave them in more pain than they started with, among other concerns. 

The assisted suicide bill will be heard on January 29, 2020, at 8:30 a.m. in the House Health and Human Services Committee. Members of the Committee can be found here 

H.B. 7, the abortion up-to-birth and infanticide bill would strip critical life-saving protections for babies in the womb and mothers. It would also strip out essential protections of conscience for medical professionals, safeguarding them from being forced to perform abortions. Because the statute is flatly stripped out, the bill would allow underaged mothers to get abortions without their parents’ consent, opening up unsafe opportunities for human trafficking and abuse. The bill would allow any medical professional (not just a doctor) to perform the abortion, leaving women in risky positions, where they could face life-altering injuries and death.

NM Senate committee approves abortion up-to-birth bill in 5-3 vote

On Monday, the New Mexico Senate Health & Public Affairs Committee held a hearing on SB-10, the abortion up-to-birth and infanticide bill proposed by Sens. Linda Lopez (D-Bernalillo) and Peter Wirth (D-Santa Fe). 

The Committee resumed its business shortly after 3:00 p.m. following a slew of technical issues where some senators could not log onto the virtual meeting, the audio wasn’t working at one point for the chairman, Sen. Gerald Ortiz y Pino, who said “I can’t hear a damn thing,” and an influx of New Mexicans tuning in caused the system to lapse. 

However, once the technical issues were finally resolved, the Committee began its proceedings, introducing the bicameral bill and its sponsors. Sen. Lopez said of her bill, which would strip away all protections for women, doctors, and babies, that “We must respect and support those who support such a decision and must take politics and the law out of” abortion despite her own sponsorship of the bill seems to put politics into the conversation.

Sen. Wirth noted how he was “honored” to support the anti-life bill. He read off a few canned talking points, claiming the current law, dormant due to Roe v. Wade, is “archaic” and that he “respects” the decisions of New Mexico women to kill their children in the womb.

Rep. Micaela Cadena, a co-sponsor of the abortion bill in the House, said during the committee that she understands “pregnancy is sacred, and as such, we must trust a woman, a pregnant person” to make the decision to abort. 

During the proceedings, New Mexicans on each side of the issue were allowed to speak in support or in opposition to the bill for increments of 30 minutes on each side, during which doctors, midwives, nurses, post-abortive women, and mothers spoke on the pro-life side. Multiple activists and “social justice” lawyers spoke in favor of the bill on the pro-abortion side.

Sen. Gregg Schmedes (R-Bernalillo, Sandoval, Santa Fe) repeatedly asked the bill sponsors why the bill had stripped away conscience protections away from the bill, despite the previous 2019 version of the bill adding an amendment to explicitly protect health care professionals from being forced to abort children. Sen. Wirth could not answer that question, claiming as a lawyer the bill did not need that explicit conscientious objection clause. Wirth also admitted that the bill would not only allow non-physicians to perform abortions but that the dangerous practice is already happening in New Mexico. 

The American Civil Liberties Union (ACLU) legal expert that Democrats brought in to testify in support of the bill, Ellie Rushforth, could not answer basic questions from Sen. David Gallegos (R-Eddy and Lea) regarding if a healthy mother could abort a healthy baby in the State of New Mexico. The witness dodged the questions, saying, “These are very complex medical decisions.” that they could not answer. 

The Bill ultimately passed the Committee on a party-line vote of 5-3, with Democrat Sens. Gerald Ortiz y Pino, Bill Tallman, Brenda McKenna, Antoinette Sedillo Lopez, and Liz Stefanics voting for the abortion up-to-birth measure. Republican Sens. Gregg Schmedes, David Gallegos, and Stuart Ingle voted against it. 

The bill now moves to consideration before the entire New Mexico Senate, where Democrats believe they have the votes to ram it through. TODAY: NM Senate committee to hear abortion up-to-birth and infanticide bill

On Monday, the New Mexico Senate Public Affairs committee will convene at 1:00 p.m. MT to consider the passage of SB-10, an abortion up-to-birth and infanticide bill.

In 2019, New Mexicans successfully defeated a radical abortion up-to-birth bill, HB-51, which would have stripped away protections for women and their children in the womb and removed “conscientious objection” protections for physicians and medical professionals. 

The bill is back in the form of SB-10, the same cookie-cutter legislation proposed in 2019, but this time it is being proposed in the New Mexico Senate, the same chamber where HB-51 was defeated. State Sen. Linda Lopez and Majority Leader Peter Wirth are co-sponsoring the bill, which is a single page (and seven lines in length), flatly stripping the statute off the books–and thus harming countless New Mexicans.

The Democrats believe they may have the votes to ram through the bill, due to the deaths of pro-life Democrat senators and the election defeats of pro-life Democrats by radical anti-life extremists. The newly grasped pro-abortion advantage by Democrats is why it is such a top-priority for anti-life extremists and Democrats in the Legislature.

Planned Parenthood abortion business has already been lobbying New Mexico legislators with misleading and false statements to support an abortion up-to-birth and infanticide bill, as reported on previously. 

According to the Santa Fe New Mexican, “Public comment will be limited. At each hearing, groups on opposing sides of the issue will get only 30 minutes or up to 10 speakers to argue their case.” The link to watch the hearing live can be found here once it is available.

SB-10 allows sex traffickers and child abusers to take a pregnant minor in for an abortion without any parental knowledge or involvement–not to mention without any reporting criteria. 

With this bill, a pregnant mother would be allowed to have an abortion at any pregnancy stage. It is a medical fact that the risk of death or serious injury to women increases to 76.6% in abortions after five months. 

This bill is ill-conceived and leaves gaping holes in state law for women to be maimed or potentially killed during an abortion, and I urge you to please vote against SB-10 for the children, the women, and the health care heroes we must protect.

As Democrats in the New Mexico Legislature are working to ram through two anti-life bills, HB-27 (assisted suicide) and SB-10 (abortion up-to-birth), New Mexicans can tune in tonight for an emergency New Mexico March for Life webcast to see what they can do to try and stop this legislation. 

The webcast, which will be streamed tonight (January 22) at 7:00 p.m. MT, will have notable faces from New Mexico and across the nation, including Father Frank Pavone of Priests for Life, U.S. Congresswoman Yvette Herrell (NM-02), Deacon Steven Rangel of the Archdiocese of Santa Fe, Elisa Martinez of New Mexico Alliance for Life, Ethel Maharg of the New Mexico Right to Life Committee, Bud and Tara Shaver of Abortion Free New Mexico, Mike Siebel of Abortion on Trial, among others.

During the event, experts will inform attendees about what they can do to stop these two anti-life bills in their tracks and reveal news about the “even worse” versions of these pieces of legislation. Abortion survivors and others will also give testimony about their experiences with abortion. 

Since the  New Mexico Capitol building has been militarized and New Mexicans have been barred from the “People’s House,” the New Mexico March for Life could not happen in-person this year, but the emergency webcast will give critical information to people across the state about what they can do to protect life in the Land of Enchantment.
