Dems reap oil billions, but their ‘green’ agenda trying to sink the state’s fortune

New Mexico’s financial strategy to safeguard and grow its wealth from local oil production is yielding significant returns, with state investment income now surpassing personal income tax revenue for the first time, according to a recent fiscal forecast. However, this progress is unfolding against a backdrop of mounting efforts by far-left Democrats to dismantle the state’s oil and gas sector through initiatives like the so-called “Energy Transition Act,” New Mexico’s version of a Green New Deal, which was passed in 2019.

For the fiscal year spanning July 2024 to June 2025, the state’s revenue from its two multibillion-dollar permanent funds and interest on treasury accounts is projected to reach $2.1 billion. This figure edges out the $2 billion anticipated from personal income taxes. The rise in investment earnings is intended to sustain crucial public programs — such as childcare subsidies and socialized “free” college — even as New Mexico faces potential declines in oil revenue due to the push for a shift to so-called “green” energy.

Meanwhile, legislators have revised the state’s income tax brackets, lowering residents’ taxes in the nation’s second-largest oil-producing state, behind Texas.

These figures serve as a foundation for budget negotiations when the Democratic-controlled Legislature convenes in January.

The state’s financial growth remains deeply linked to oil production, which continues to drive revenue increases at a more moderate pace. However, this growth exists in tension with legislative priorities, including far-left energy policies to curb fossil fuel reliance. Efforts like the Energy Transition Act have been criticized as a direct attack on New Mexico’s oil and gas industry, threatening a vital sector supporting the state’s economy.

Economists predict New Mexico will see a record-setting $13.6 billion in general fund revenue for the fiscal year running from July 2025 to June 2026, reflecting a 2.6% increase from the prior period. This surge leaves room for an additional $892 million in state spending, representing a 7% increase. In total, the state’s general fund income is expected to exceed its core annual spending obligations by a staggering $3.4 billion.

Recognizing the windfall, lawmakers are exploring new savings initiatives to safeguard against future economic uncertainty. One proposal would create a $1 billion trust to support mental health and addiction treatment services, responding to growing public concern about crime and homelessness. Lawmakers may also revisit a proposal to establish a trust for Native American education — all cutting into oil and gas funding.

While the economic gains are undeniable, “progressive” energy policies like the Energy Transition Act risk eroding New Mexico’s economic foundation. The act, which aims to transition the state away from fossil fuels, could ultimately jeopardize funding for the very social programs lawmakers are striving to protect. The state’s oil and gas sector not only fuels public revenue but also supports tens of thousands of jobs, a fact that some believe the far-left faction of the Democrat Party has overlooked in its pursuit of environmental goals. Democrat NM legislator quits due to undisclosed ‘health-related’ reason

Veteran State Rep. Eliseo Alcon (D-Milan) of District 6 has officially resigned from his seat. His son and political consultant, David Alcon, confirmed the news, stating, “On Saturday, Rep. Alcon submitted his retirement application to PERA and his notice of retirement to the Legislature.” 

Alcon formalized his decision in a letter to the New Mexico Secretary of State. The reason for his sudden departure is health-related, though the specific condition was not disclosed. Alcon will turn 75 in January, according to reports.

First elected in 2008, Alcon represented a two-county district comprising Cibola and McKinley in western New Mexico. He was re-elected to a ninth term in November, securing 59% of the vote.

Alcon’s career included work as an infirmary technician at the Kerr-McGee uranium mines and as a magistrate judge. He also served as a combat medic in the U.S. Army during the Vietnam War. 

As chairman of the New Mexico House Labor, Veterans, and Military Affairs Committee, Alcon championed veterans’ issues at the Roundhouse. 

Following the news, state Sen. Pete Campos (D-Las Vegas) wrote on X, “Thank you Eliseo Alcon-a true statesman-for your unselfish/devoted years of service to your family-country-state. You’ve earned your retirement as a State Representative. NM is better because of your many contributions to improve our daily living. I wish you the best-Siempre!” 

The Governor will appoint a replacement for Alcon’s seat, with nominations coming from the county commissions of Cibola and McKinley counties. It is expected that the seat will remain in Democratic hands, and possibly in the hands of his son, David.

NM House Dems, GOP elect new leadership ahead of upcoming session

On Saturday, House Republicans and House Democrats elected new leadership in their respective caucuses ahead of the 2025 Legislative Session, which begins on January 21st.

House Democrats again tapped Speaker Javier Martínez of Albuquerque as their nominee for the speakership, current Whip Reena Szczepanski of Santa Fe as their new majority floor leader, after Leader Gail Chasey of Albuquerque announced her retirement and did not seek reelection to the House.

Rep. Dayan “Day” Hochman Vigil of Albuquerque was chosen as the Democrats’ new whip, keeping Chairman Raymundo Lara of La Mesa as the caucus chair. 

On the Republican side, the House GOP tapped Rep. Gail Armstrong of Magdalena, the current caucus chair, to be the minority leader, following Rep. Rod Montoya of Farmington, who chose not to run for reelection to the position. Armstrong is the first female GOP New Mexico House leader in history.

Republicans chose to keep current Whip Alan Martinez of Bernalillo as the minority caucus whip, while former Rep. Rebecca Dow, who recently reclaimed her seat in the House after running for governor, has been restored as caucus chair after previously holding the position.

As the January 60-day legislative session rolls upon us, it is unclear what changes the new leadership will make, regarding decorum, strategy, or way of conducting business in the House.

With both sides elevating relatively new legislators to many of the leadership positions, it remains to be seen if the chamber will continue in its same trajectory, which — at least for the Democrat majority — has veered further and further to the extreme left.

‘Shame on you’: Livid gov trashes ‘never serious,’ ‘failed’ Dems for resisting her

On Monday morning, Governor Michelle Lujan Grisham visited a problematic area in downtown Albuquerque to highlight the need for the upcoming special legislative session aimed at addressing public safety and mental health issues.

Governor Lujan Grisham criticized some legislators for canceling critical meetings, lunches, and hearings ahead of the special session, stating, “Which tells me they were never serious about supporting any of these issues in the first place. My message for them on behalf of the business owners and the people living here is, ‘Shame on you.’”

Amid pushback from Democrat leaders, the governor declared, “Enough is enough.” She emphasized that legislative and city leaders, including Albuquerque Mayor Tim Keller, are committed to tackling these pressing issues. “I’ve got legislative policy markers, lawmakers who have a sense that the mayor and I, and others, aren’t really considering this issue from an affordability and a place of compassion,” Lujan Grisham said, aiming to prove her critics wrong.

During her visit to 1st Street and Prospect Avenue, an area plagued by homeless encampments, Mayor Keller noted, “We had 3,000 calls for service for encampments, and as I mentioned, we clean about 200 encampments a month.” Both the governor and mayor believe the proposed bills could bring much-needed relief. “You can’t walk on the sidewalk. You can’t enter these businesses. These business owners can barely keep their doors open. They spend more time on their own public safety and the environment around their business,” Lujan Grisham added.

One proposed bill would change how courts handle offenders found incompetent to stand trial. “If these individuals will not seek care and break the law and come right back to the streets, there is nothing we can do to interrupt this chaos,” the governor stated.

Local business owners, like William Johnson of ABQ’s Best Equipment Service, are frustrated with the situation. “We’re scared to be out there sometimes because they are throwing needles over the fence while we are back there working. Same thing, they are out there smoking whatever,” Johnson said.

Governor Lujan Grisham urged New Mexicans to support the special session, stating, “The climate is so harsh that you are not safe anywhere. I would say to those legislators, ‘I don’t believe New Mexicans think you can wait, and I don’t frankly understand why you think you can.’” She called on citizens to contact their lawmakers and hold them accountable for either addressing the issues or allowing the chaos to continue.

The special session, set to begin on Thursday, has sparked significant debate among lawmakers. Democrat leaders held a news conference on Monday, arguing that the session is a waste of time and taxpayer money. They claim there has been insufficient time to reach a consensus on the proposed bills.

“We appreciate the important issues that the governor has raised, calling this special session, particularly around the nexus of behavioral health care and public safety,” said House Speaker Javier Martinez. However, he emphasized the need for thorough legislative consideration, stating, “As state lawmakers, we also have a constitutional duty as a separate and coequal branch of government to fully consider the legislation that comes before us and the potential impact it may have on New Mexicans.”

Senate Majority Leader Peter Wirth criticized the timing of the special session, stating, “Special sessions only work when the bills are cooked. We thought we had an agreement with the governor that she wouldn’t proceed unless there was consensus. The governor went ahead and called this session before we had even started working on these bills; that’s certainly her prerogative.” He added, “We have worked hard to try and find bipartisan consensus on the bills that were proposed. As the speaker said, we’re just not there.”

Senator Mimi Stewart expressed concern about rushing the process, stating, “We do not believe these concerns can be effectively remedied in a very condensed special legislative session. It’s simply too important to rush into this and risk harming that will take up more of our time down the road to unwind and repair.”

Republicans, meanwhile, are eager to address public safety issues. House Republican Leader Rod Montoya said, “Once again, progressive Democrats have failed to take the New Mexico crime problem seriously. House Republicans are prepared with a tough-on-crime package and are ready to work. New Mexicans are relying on their elected officials to ensure their safety. However, this chaos in the Roundhouse is disheartening and leaves New Mexicans feeling less secure than ever.”

Senate Republican Leader Greg Baca echoed this sentiment, stating, “Despite all of the voices of detractors on the prospect of improving our state, anything we can do to make our families safer is worth our time. We have many bills we are ready to introduce during this special session that we believe would make a measurable impact in the lives of the people of our state and we are ready to work with anyone to meaningfully address public safety.”

Governor Lujan Grisham’s spokesman released a statement criticizing Democrat legislative leaders for not engaging meaningfully with the governor’s proposals. “The governor’s proposals to improve public safety in New Mexico in a special session should have come as no surprise to any lawmaker who was paying attention. Legislators had competency legislation on their plate beginning in January, and they rejected it. Gov. Lujan Grisham then began signaling her intent to call a special session before the end of the regular session in February.”

The statement continued, “Democratic legislative leaders have failed to meaningfully engage with the governor and her team on the substance of her proposals to help keep New Mexicans safe. Over the past several months, they’ve resisted productive discussions of what would be possible to accomplish in a special session and refused to offer any viable legislative alternatives. If lawmakers adjourn without taking up the governor’s proposals to make our state safer this week, the decision will come at the expense of New Mexicans who are demanding public safety reforms. Just today, the governor met with two business owners in Albuquerque who have been assaulted and burglarized at their place of business. Crime is a serious problem in New Mexico. This can’t wait.”

We need candidates to run for the Legislature — Here’s how!

New Mexico is at a crisis point where the most extreme far-left proposals are being rammed through the legislature, as we saw some this session to hike gas prices, force us to wait a full week to make a simple gun purchase, and so many others. 

Republicans fought hard for your rights this legislative session, as we did last year, but we need more of us to run — and win — to stop the bleeding caused by the other side.

Make sure you are prepared to fight to win in the race you are entering, and it is recommended you talk to leaders in your area to make sure you are the only candidate in the primary so you can win in November against the Democrats. If there is someone else in the primary, make sure you have discussions to make sure you are ready to do what it takes to win both the primary and general elections.

Also, make sure you know what you are signing up for. You will need the flexibility to take off of work each January-March in even years and January-February in odd years. You will attend interim meetings across the state after the legislative session, so be prepared to take off work for those also. Legislators do not make a salary (exclusive of set per diem rates for your hotels, meals, and gas), so take all of these factors into account before you run for office.

So, here is a how-to guide for becoming a candidate for getting on the ballot to run for the Legislature!

What you will need to get started: 

Pick a Treasurer

To begin your campaign, you will need a campaign treasurer. Find someone you know and trust to help you with this. 

Open a CFIS Account

You will need to open a CFIS (Campaign Finance Reporting Information System) account through the Secretary of State’s (SOS) website for your campaign by clicking this link here or by visiting https://login.cfis.sos.state.nm.us/ 

This will be used for reporting campaign contributions. 

The first primary report is due on April 8, 2024, for the reporting period spanning October 3, 2023, to April 1, 2024. All other campaign reporting dates can be found linked here or by visiting https://www.sos.nm.gov/candidate-and-campaigns/how-to-become-a-candidate/campaign-finance-reporting-schedule/ 

Save your Candidate Campaign Committee Registration Form. Print it out. This will be needed later.

Also, while in CFIS, fill out your Financial Disclosure Statement. This will be needed on filing day, so print this out also. 

Get an EIN Number

Your campaign will need an EIN number through the IRS to conduct its activities. Here is a link to the IRS website to apply for that: https://www.irs.gov/businesses/small-businesses-self-employed/apply-for-an-employer-identification-number-ein-online 

Make sure to save your EIN number and, ideally, make a copy of the “success” page affixed with the number for your records. You will need this EIN document in the future. 

Open a Bank Account

Now that you have successfully opened a bank account and a CFIS account, you can now open a bank account. Make sure to bring the official printed documents from the SOS and the IRS to do this. You will need a campaign treasurer to come with you to open the account, or the bank may need them to sign forms remotely if they cannot physically come with you to the bank. I recommend they be there in person.

Once you have your bank information, you will need to enter this into CFIS. 

Gather Signatures 

Now that you have all these steps done, you must register and get your petition signature site up and running. You can do that on the SOS site by clicking here or by going to this link: https://www.electronicpetitions.elections.sos.nm.gov/ 

To get paper signature forms ready, you will need to find the form here (https://www.sos.nm.gov/wp-content/uploads/2023/10/2024-Primary-Statewide-Nominating-Petition_English.pdf) on the SOS website and ensure it is filled in correctly for your campaign with the exact name on your voter registration, the correct home address, the proper county, and the proper office (such as State Representative District __ or State Senate District __). Walk around your neighborhood or disseminate these forms to friends to gather signatures. Note: the form is also available in Spanish here: https://www.sos.nm.gov/wp-content/uploads/2023/12/2024-Primary-Statewide-Nominating-Petition_SPANISH.pdf 

Each district has a different number of signatures required for your race. The required number of signatures you will need to gather is found on pages 31-33 of the SOS candidate guide linked here or found here: https://www.sos.nm.gov/wp-content/uploads/2024/02/2024-Primary-Candidate-Guide.V2-1.pdf 

File for Office

You will file for office at the county clerk’s office in the county where you live. For example, if your residence is in Albuquerque, you will file at the Bernalillo County Clerk’s Office. If your residence is in Rio Rancho, you will file at the Sandoval County Clerk’s Office regardless of how many counties are in your district. 

IMPORTANT: Filing Day is 9:00 a.m. to 5:00 p.m. on March 12, 2024, and on March 12, 2024 only! It is vital to have all your signatures collected by then and ready to go. Print your online signatures via the tools on the petition portal site and bring in the petitions you have gathered by hand as well. Ensure they add up to ideally 150% of the number required to account for any errors that may exist in the hand-gathered signatures. 

DO NOT BE LATE TO FILING DAY. Getting to the Clerk’s Office as early as possible (9:00 a.m. sharp) is recommended.

Now that you have completed all of these steps and have all the proper information filed with the county clerk, you should receive a letter from the clerk telling you your filing was successful.

Member of NM House GOP leadership tapped for open state Senate seat

In a recent development within New Mexico’s political landscape, Greg Nibert, a Republican and a member of the State House since 2017 and the House Minority Whip since 2023, has been appointed to the State Senate.

This appointment, announced on January 5, comes from Gov. Michelle Lujan Grisham and fills the vacancy in Senate District 27. This seat was left open following the retirement of Republican Senator Stuart Ingle in October.

Senate District 27, which Nibert will now represent, is situated around the Roswell area. This move to the Senate marks a significant shift in Nibert’s political career, offering him a broader platform and increased responsibilities within the state’s legislative framework.

As Nibert transitions to the Senate for the 2024 legislative session, his departure from the House of Representatives triggers a need for a replacement. The process to fill his now-vacant House seat is set to commence, overseen by the Chaves County Commission alone, as his former House district only covers one county. 

The upcoming legislative session will likely be an important period for Nibert as he adjusts to his new role and tackles the challenges and opportunities that come with being a state senator. 

As the process of finding Nibert’s successor in the House begins, attention will also be paid to how this change affects the balance and dynamics within the New Mexico legislature. However, the Chaves County Commission must work fast to name Nibert’s successor, as the 2024 Legislative Session begins on January 16.

It is immediately unclear who the potential candidates are to replace Nibert in the minority whip position following his promotion to the Senate.

NM’s film tax credits scrutinized by powerful Democrat committee chair

State Sen. George Muñoz, a Democrat from Gallup and the chairman of the powerful Legislative Finance Committee has raised concerns about New Mexico’s film production incentive program. This initiative has been a subject of scrutiny as questions persist regarding its cost-effectiveness.

Sen. Muñoz has previously questioned the workings of the incentive program, as have other skeptics who wonder if the economic impact of New Mexico’s thriving film industry is truly as substantial as it seems.

In a letter to the New Mexico Film Office, Sen. Muñoz has requested a detailed report on how the film tax credit is calculated, eligibility requirements, and any updates or changes to the criteria. His concern primarily revolves around the unique structure of the program, where dividends are paid out after production companies submit receipts for their costs, unlike traditional tax credit initiatives.

Moreover, Sen. Muñoz has sought an opinion from Attorney General Raúl Torrez on whether the incentive program violates the state’s anti-donation clause, which prohibits government agencies from making donations to private enterprises. If the attorney general’s office determines a violation, it may necessitate a revision of the program.

The film incentive program has long been scrutinized, with a recent Legislative Finance Committee study revealing that it accounts for a significant portion of all state economic development incentives but provides less than 1% of the film industry’s share of private employment. The study questions the cost-effectiveness of the program, citing that it costs the state over $100 million in payouts in fiscal year 2023 but does not attract substantial private investments.

The film industry’s employment figures are also under scrutiny, with the program generating approximately 8,000 jobs per year at a cost of around $22,800 per job created, higher than other job-creation programs.

While New Mexico has become a popular destination for filmmakers due to the incentive program, which offers significant rebates on qualified expenses, the recent questions raised by Sen. Muñoz and the legislative committee study have rekindled doubts about the program’s economic payoff.

Despite these concerns, the program continues to enjoy political support, making it unlikely to change or disappear in the near future. It benefits from strong revenues generated by the oil and gas industry, which contribute to the state’s coffers. If these revenues were to decline significantly, lawmakers might reconsider the program’s incentives and evaluate their value to the state’s economy.

Democrat NM lawmaker to resign for job in another state

In a shocking Monday announcement, University of Colorado Boulder Chancellor Philip DiStefano revealed that New Mexico state Sen. Benny Shendo, Jr. (D-Jemez Pueblo) was appointed Associate Vice Chancellor for Native American Affairs at CU Boulder. He will relinquish the state Senate seat by the spring of 2024.

A graduate of the University, Shendo brings his experience as a New Mexico state senator and his former high positions, such as tribal administrator and lieutenant governor for the Pueblo of Jemez.

A commitment to Native American affairs has marked Shendo’s professional journey, evident in his past roles at the University of New Mexico and as part of the dean of students office at Stanford University. His multifaceted background positions him uniquely for his new role, which will see him contributing to the Office of Government and Community Engagement.

In his capacity as Associate Vice Chancellor, Shendo will play a key role in fostering connections with tribal governments and communities across Colorado. His duties extend beyond the campus, involving collaboration with state and federal entities on matters pertaining to tribal affairs and higher education.

Shendo stated in a news release, “I cannot wait to get started in this new role at CU Boulder to strengthen our relationships with the tribes of Colorado and those historically connected to Colorado and to build a strong, supportive Native American community on campus for our students, faculty, and staff.”

Shendo is poised to assume his full-time position at CU Boulder on March 1, a move that necessitates his departure from the state senate. His decision to transition into this role underlines his dedication to advancing Native American initiatives within the realm of higher education.

Chancellor DiStefano highlighted Shendo’s appointment, saying in a news release, “We are delighted to welcome Benny Shendo back to the CU Boulder community,” adding, “His wealth of experience and commitment to Native American affairs will undoubtedly contribute to the university’s ongoing efforts to create an inclusive and culturally rich environment.”

Shendo was first elected in 2012 and currently chairs the powerful Senate Tax, Business & Transportation Committee.

Amid radical woke agenda, NM House GOP offering parents legal option

On Monday, the New Mexico House of Representatives Republicans announced at a press conference featuring Rep. Luis Terrazas (R-Bayard) that they are offering parents in the state a parental/guardian consent form that attorneys have extensively reviewed to allow the option to forego the woke agenda being pushed in schools due to recent legislation, including H.B. 7 and S.B. 397.

The House Republicans wrote, “The following form is designed to help parents/guardians explicitly exercise their right to be fully informed prior to their child accessing medical and behavioral health services, or some instructional materials.”

“Parents/guardians are responsible for making educational and health care decisions for their children until they reach the age of majority. A minor child cannot consent to his/her own educational decisions or medical treatment. It is important for parents/guardians to remain engaged and informed with school district staff to ensure their children are receiving the appropriate education and health care. Parent/guardian engagement ensures the highest standard of care.”

The form gives multiple fields for notification, including “any health care services, referral for services, class, lesson, instruction, curriculum, assembly, guest speaker, activity, assignment, library material, online material, club, group, or association concerning transgender ideology, gender affirming care or gender identity,” “abortion,” “contraception and other family planning,” “primary health care,” and “mental or psychiatric care.”

The form concludes, “If I am not given prior notification and the ability to make an informed decision concerning the wellbeing of my child, I withhold consent for the items checked above.” 

In an op-ed by New Mexico House Republican Leader Greg Nibert wrote, “Parents have put up with a lot over the last few years, but take away their right to protect the health and safety of their kids, and it is clear that New Mexicans of all ethnic, social and political persuasions have had enough. The nonstop and aggressive march of progressive social policies in New Mexico has finally struck a nerve.”

“I and other Republicans are moving forward with an effort to advise parents on how to inform schools officials of their demands when it comes to their children’s welfare. Republicans are advocating that every parent of a minor child in New Mexico’s public schools sign and send a letter to their school’s administration requiring that they be notified before any gender ideology information, gender altering services, hormone blockers, psycho-tropic medications or abortion services are provided to their child. The recommended form letter has already been reviewed by lawyers who are ready and willing to engage on this important issue.”
