Dems drop second anti-gun bill of the 2023 Legislative Session

On Wednesday, Democrats dropped their latest anti-gun bill they will introduce this upcoming 2023 Legislative Session.

Far-left state Rep. Pamelya Herndon (D-Bernalillo) is sponsoring a bill, H.B. 9, which will force New Mexicans to lock up their firearms in “a gun safe or a device that prevents a firearm from being discharged or from being used to expel a projectile by the action of an explosion or a device other than a gun safe that locks a firearm and is designed to prevent children and unauthorized users from firing a firearm, which device may be installed on a firearm, be incorporated into the design of the firearm or prevent access to the firearm.”

If the gun owner does not lock up any and all firearms and their gun somehow was used in an offense by a minor causing “great bodily harm” or death, the parent of that child could be made a felon if the victim of the crime is killed or permanently disabled. 

As noted by even some Democrats in the chamber during a July 2022 preview of the bill, it would be the first crime proposal to base a defendant’s sentence not on their own actions but that of someone else (a minor) who got ahold of a firearm. 

The bill does not, however, include provisions protecting the gun owner if the firearm was stolen, nor does it account for the de-facto tax it burdens the owner with being forced to find a new locking device to place it at all times. The bill is also blatantly unconstitutional.

Previous versions of this bill sponsored during the last two legislative sessions by state Sen. Antoinette Sedillo-Lopez (D-Bernalillo) have died.

The first anti-gun bill dropped by Democrats is one by state Rep. Patricia Roybal-Caballero (D-Bernalillo), H.B. 50, which bans all citizens who own firearm magazines greater than ten rounds and makes any offender a felon.

  1. I am sure this is the first of many bills intended to take away the rights of law abiding citizens. Instead of introducing bills for the common welfare, they aim to endanger a targeted segment.

  2. I’m new here- Gun owners are not already legally and ethically obligated to lock firearms with a device or in a safe box? This seems to be common sense.

    1. If someone is trying to kick in your door at 2 a.m., you probably don’t want to try to remember the combination to your gun safe before you can defend yourself and your family. When it says, “the right of the people to keep and bear arms shall not be infringed”, it means exactly what it says. HB-9 is just one more effort to try to whittle away at our rights. If it passes, it will not survive constitutional scrutiny.

    2. If someone breaks into your home in the middle of the night wielding a gun, can you get to your gun safe and remember the combination and open it before the intruder gets to you? I doubt it. My 3 daughters were born in ’70, ’72 and ’75. I was a Police Officer at the time. I kept my gun in the holster on my gun belt, hanging on the headboard in my bedroom. All 3 of my girls were taught not to even touch my gun and they never did. Today they are 52, 50 and 47 and they all now own their own guns. The only time any of us have fired our weapons was at the shooting range and using approved safety measures. Guns are tools much like a hammer. And like a hammer, I never use it unless I need it and it can kill someone just as easily as a gun. Any tool can be deadly in the wrong hands.

    3. Where R you from? No order statute mandate by law can super cede the bill of rights and the Constitution. All rules and code are treason against the republic and the people.

      Go back to California or what ever commie zone you came from. Being armed is like breathing air. Anywhere in this land you can open carry its the law of the land. But cowards look for permission. Land of the because of the brave.

  5. These supposed representatives who are going against the Constitution should have to step down at a minimum. They are not doing their job they took an oath to uphold.

    1. They haven’t even read the constitution and don’t believe in the oath they take.
      We need to have smart, fair candidates who actually can read and understand the consequences of bills before they are passed.

  6. WHAT do I want? I want a guarantee that a criminal can never access a gun to commit a crime. How can the governor do this?

    1. Lock up the criminals. Execute those that commit capitol crimes. Easy Peezy. Oh wait, can’t offend the criminals must attack the tool.

  7. Many of NM electret’s are just as stupid as the conservatives that think they are democraps due to our poor brainwashing school systems across the state. NM, stand up for your beliefs and realize the democraps are about controlling you and taking your rights to think for yourself away from you!

  8. Don’t NM legislators have the Internet, if they do they would find that some of these laws they are wasting time on have been put before other states and have been overturned by different courts.

  9. This “governor” and the rest of her ilk should put their money where their big flapping mouths are and publicly eliminate any armed security protection they have in place for themselves. Idiot voters who support their regime should be required to post big signs outside of their homes proudly announcing that “This Is A Gun-Free Zone.” They should also sign contracts stating that they will never call armed police for help. Talk is cheap. Actions speak louder than words. Step up!

  10. Everyone needs to ask this very private question to themselves. Am I willing to use the second amendment for its intended purpose? Well folks it may have taken almost 200 years so hopefully your bloodlines aren’t so watered down that you think voting trumps the actual use of the 2nd amendment. Step 1 First amendment *f@$k you come take it. Step 2 second amendment. You should have listened corrupt law enFORCEr. Lights out. This is the simple fix to an age old question, it’s really like that, you have to use your rights not just talk about them and how voting isn’t fair. This isn’t a voting box issue it’s an ammo box issue and everyone needs to materialize that before the cops come around my house because my stance is the final coffin box issue and it’s my RIGHT to make that decision. you have been warned to leave me alone and let me live a peaceful life, that’s as fare as I’m willing to be at this point.

Are you all seriously going to hold that peace of paper in front of you screaming stop i have rights!? while an armed law enFORCEr has his barrel at your sovereign body. NO TRESPASSING! It’s a sad day to be a cop when you come knocking on people’s doors with Ill intentions.
