Alamogordo officer shot by violent thug: NM’s flawed pretrial release law in action

In 2016, the voters of New Mexico passed a constitutional amendment removing cash bail and instituting pretrial release, which has since let violent thugs back on the streets to wreak havoc on the state’s communities.

Albuquerque’s crime-plagued streets are often mentioned as examples of how this far-left policy has failed the state, but it is now permeating even further into smaller communities — this time in Alamogordo.

“State Police agents learned that on July 15, at around 2:30 a.m., an APD officer initiated a traffic stop on a Honda passenger vehicle driven by Dominic De La O, 26, of Alamogordo for driving with no headlights or taillights. De La O fled from the officer and crashed into a light pole at the intersection of Delaware Avenue and 1st Street. De La O fled the crash scene on foot and a foot pursuit ensued,” according to State Police.

“At some point during the foot pursuit De La O presented a concealed sawed-off shotgun and fired it toward one of the APD officers, striking him in the face. A second APD officer fired his duty weapon at least once towards De La O striking him in the leg. De La O continued to flee on foot, and after a physical confrontation with officers at a residence on the 100 block of Delaware, De La O was taken into custody. De La O was treated and released from the hospital and taken into custody by the New Mexico State Police.”

De La O was previously sprung from jail awaiting trial from January 2023 charges. 

“In late January, De La O was shot twice in the back by Alamogordo police when he pulled a handgun during a scuffle with officers, according to court records. De La O was facing one felony drug charge and several misdemeanors in that case and was awaiting trial,” the Albuquerque Journal reported. “Court records show a warrant was issued for De La O’s arrest on Wednesday after he violated his conditions of pretrial release by being at a party where a shooting occurred.” 

De La O is being charged with the following:

  • Attempt to Commit 1stDegree Murder
  • Aggravated Battery on a Police Officer with a Deadly weapon
  • Tampering with Evidence
  • Aggravated Fleeing of a Police Officer
  • Resisting and Evading a Police Officer
  • Criminal Trespass
  • Lights Required on Vehicle
  • Failure to Yield to an Emergency Vehicle
  • Reckless Driving

The officer was rushed to El Paso and remains in critical condition following surgery.

  1. Eventually, this scum will kill someone. Most likely a police officer. Conservative judges and counties have to do what the progressives do; Ignore these stupid laws and keep these criminals in jail. Or just shoot to kill.

  2. Believe most cops are good folks, not so much for our elected officials. Not sure folks know what they are voting for either. On the ballots, what is stated is not what the new law means. Most folks do not take the time to look the new laws up to understand the BS that is written.

  4. This is a terrible tragedy; foremost is taking care of the officer and the officer’s family — Imagine this happening to someone dear to you and the anguish it would cause. We would all want definitive answers as to why and how- we owe a complete and unbiased investigation, and ALL responsible parties to be held to FULL account.

  5. The revolving door crime policy undertaken by the neo Bolshevik’s that currently run this state and country are by design intended to break down law and order so the “state “ can step in . Their goal is federalizing everything from schools to public safety so that their communist goals can be achieved, it’s top down communism. By federalizing everything, power is removed from local elected officials and transferred to nameless bureaucrats that have only contempt for the unwashed masses. Unfortunately this ugly scenario will be played out over and over again as cops are vilified and shitbag criminals are glorified by a satanic unjust ruling class.

  6. Do any of you know the percentage of citizens who are arrested and charges are later dropped, reduced, or not believed at trial by the jury. It costs taxpayers a fortune to incarcerate people who are “innocent until proven guilty beyond a reasonable doubt.” Clearly you have no knowledge or respect for the patriots who created this republic by fighting a war for freedom from despots who could take property, freedom, or lives on a whim. Maybe living in Putin’s Russia is your cup of tea.

    1. I know you might be concerned about the innocent people out there, but you have to trust your law enforcement. If they make the arrest, they had sufficient evidence to apprehend the subject. If the courts are too easy on them and let them go free waiting for trial, then this is the situation you get. I feel a subject deserves the right to a free and fair trial,but we can’t let those charged of violent crimes run free until the courts make an opening in their schedules. Obviously he has been waiting for his case to be brought to trial for 6 plus months. That is what is ridiculous. Hold them for trial, but reform our court system to get the trials done in a timely manner.

    2. The officer is now dead. Our founders allowed bail to those that deserved it. Today, the communist tyrants called democrats, have usurped the judges ability to “judge” and across the country illegals, criminals and gang members are running rampant. Pretty soon scared citizens will start to solve the problem. We really do not want that but there may be no other choice. The old joke is “What do you call a liberal who has been mugged”? A Conservative!!

    Democrats have been in charge of the NM legislature for almost 100 years, with very few exceptions. That’s how the Democrat liberals got the no-cash bail amendment passed. Violent repeat offenders are now released on their own recognizance by the courts as a result, almost before the arresting officers have finished the paperwork.
    NM is rapidly becoming the crime-ridden welfare state that California is.
    ABQ’s mayor refuses to acknowledge that the rising crime rate due, in part, to the homeless population; and he refuses to do anything serious about it. Stores are starting to be mob raided, a la San Francisco. A burger stand that has been here for close to 50 years has closed saying that it was unsafe to keep operating in ABQ.
    Getting out a year too soon is better than a week too late.

Rather than paying the salaries of the crooked politicians who run this state for their benefit and agendas, and not for the good of the people who have ‘elected’ them to these positions, I would prefer my tax dollars are spent to hold on to the accused until such time they are proven innocent if that is the case. I don’t believe our police officers are in the job because they want to chase, shoot at, arrest, folks who are trying to live a lawful life of peace. It can’t be coincidence the same people are always in the wrong place at the right time…just sayin

I do remember asking why are the criminals being let go, why are bonds disappearing, why are police officers being attacked and no repercussions. This man was killed because the law failed him, his family and New Mexico. Repeal the law. There has to be an emergency recall, an emergency session called and repeal this amendment. Do you hear us Governor Grisham, we are not safe.

  12. I know the bail system was abolished in 2016 by constitutional amendment in 2016. how do we get it back. our communities were much safer with bail laws.

    1. Judges need to ignore the law. Let the dems file suit. Eventually the citizens will solve the problem on their own.

  13. I am quite sure that this criminal has killed before if he shoots at Police Officers so freely. I an willing to bet there are more unaccounted victims out there. Bail is not for gun offenses or habitual criminals. Keep this type of criminal locked up…do not let them free at any cost!!!

This Guy was the one who killed AUGUSTINE MORENO, HE STILL HASNT BEEN CHARGED BUT ONE OF THE GUYS WHO WAS APART OF IT WAS ARRESTED N STILL HAVENT ARRESTED THIS PIECE OF CRAP FOR TAKING A YOUNG NANS LIFE WHO WAS 16 WHEN HE DIED.
