Monday bill hearing on proposal to criminalize guns at the polls

On Monday, the House Government, Elections, and Indian Affairs Committee (HGEIC) will consider S.B. 44, which will ban anyone except security and law enforcement from carrying a firearm within 100 feet of a polling place.

Despite mass shooters specifically targeting “gun-free zones” as easy targets, state Sen. Peter Wirth (D-Santa Fe) is pushing the anti-Second Amendment law that would restrict firearms from polling places.

The fiscal impact report for the bill reads, “Senate Bill 44 creates the new crime of unlawful carrying of a firearm at a polling place, a petty misdemeanor, punishable by up to six months in jail.”

The Law Offices of the Public Defender write, “SB44 does not include an intent element. Analyst recommends a requirement that the person ‘intentionally carry a firearm at a polling place’ as an element of the proposed crime. Presuming that the purpose of this new law is to prevent and punish purposeful voter intimidation, the bill should not criminalize the inadvertent act of carrying a firearm to or near a polling station by someone who might have a conceal and carry permit and simply forgotten that the firearm was still on his or her person. An ‘intentional’ or ‘purposeful’ requirement would better target culpable conduct of carrying a firearm to a polling place as an act of

intimidation.”

The bill previously passed the state Senate 28-9.

  1. So now the Communists in Santa Fe want to force us to choose which laws to follow. Do we follow Constitutional Law which states politicians shall not infringe on the right to bear arms, or do we follow Communist Santa Fe Law which criminally ignores Constitutional Law and is null and void?

  2. The selected official are making law abiding citizen felons and criminals. I have a 2A right by the federal government. SHALL NOT BE INFRINGED UPON. We need to go to capital and have an old fashioned MLK style sit in. Make them remove me by force while I remain peaceful..

  3. Criminals must be salivating waiting for when they know a law abiding citizen cannot possess a gun. Then they can break in safely, or freely shoot anywhere, without the worry of being shot back at. CRIMINALS have more rights than a law abiding citizen. I know I must be waking up on another planet – where common sense does not exist.

  4. This is all part of the Soros agenda, divide, unarm, and conquer. NMs are falling for it. The socialist Democratic Party are using NM as a test bed of their un American woke agenda. If they can pass it in NM other states will fall. It is time for Free New Mexicans to stand together. Many New Mexicans have accepted the gravy train as a way of life. Many others are conservative in thought but blindly vote for the Soros democratic socialist agenda because our schools teach us to be democrats. Time to wake up and follow your heart and spirit and take our freedoms back.
