On Monday, farming and ranching store Bar G Western Wear in Portales announced via Facebook that they had been served with a cease and desist order by State Police for keeping their doors open. The store sells essential items needed by farmers and ranchers to keep their businesses running.
Bar G Western Wear’s post reads, “Soooo folks… we’ve just been served with a CEASE and DESIST order! Apparently there were several complaints against us. (Snitches/Busybodies…..who would have thought). The NM State Police were very professional and nice. We will pursue this further. Thanks for the overwhelming support!”
State Rep. Gregg Schmedes (R-Tijeras) responded to the news with outrage, writing, “Apparently Governor Grisham doesn’t believe farmers & ranchers are essential. Where are they supposed to go to get supplies and work clothes? MLG, you’re wrong. These are the good guys, and they are ESSENTIAL. #TooFar”
The Republican Party of New Mexico has pushed back on Gov. Michelle Lujan Grisham’s orders that allow large corporations like Walmart to keep their doors open during COVID-19, while small “mom and pop” shops are hurting, many being sent cease and desist orders if they remain open to provide essential goods and services to their communities.
“Somewhere the Main Street owners of mom and pop stores in New Mexico need to be spoken for,” said Republican Party of New Mexico Chairman Steve Pearce.
Lujan Grisham’s office shrugged off the concerns by writing, “Any half-thought-out proposal about picking winners and losers and allowing partial closures … will lead to more illnesses and more death.”

Small businesses need to be allowed to be open! What about a restriction like no more guests than like 10 people allowed in the store at a time? There has been a restriction in grocery store, small businesses will not die if nothing is done!

What about those of us that have animals and need our feed. I have chickens and goats. Walmart feed doesn’t do well for egg production. My husband is an essential. He needs gloves, boots, and jeans. I posted the following on my Facebook page today following the closure of yet another small business in Portales, I don’t usually do this sort of thing but I am outraged that we in rural NM are being treated this way, I understand the “stay at home” orders, we’ve been home since the beginning of this without fail, but I believe the small businesses can sanitize their buildings as well as, if not better than, the large stores. My husband is on oxygen 24 hours a day and the delivery guy doesn’t slip the tanks under the door, they come in and we welcome them: I’m just going to go ahead and get on my soapbox for a second because this is so outrageous….in addition to this situation, what is fair about Walmart and the convenience stores being able to continue alcohol sales but liquor stores are forced to close…I’m not even a drinker, this just seems like a power play and a very poor decision. Come on Governor Grisham, get a grip and help these small businesses stay in operation, allow them to open even with restrictions of a limit of people in the store. I believe that rural New Mexico is totally ready to start a small phase-in of reopening small businesses, the problems of the Rio Grande Corridor are not the problems of the rest of New Mexico. You are the Governor of the entire state, please consider your actions. Perhaps with conditions, allow the small businesses to reopen. If the big box stores can stay open these folks should be able to stay open as well. You are killing the economy of this beautiful state…..

These cease and desist orders are unconstitutional and therefore null, void and without effect. Nowhere in our founding documents is any public servants given the authority or jurisdiction to undermine the supreme law of the land. in doing so, they perjure their oath and commit treason, insurrection and sedition against the people. This invokes sections 3 and 4 of the 14h amendment, which is self executing, and any who violate this must immediately step down and forfeit all pensions, salaries and benefits. She can and should be sued in her personal capacity, since she is acting outside her limited delegated authority.

SUMMARY:
Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.

They are essential in the fact that they are owned by individuals who have been in business for over 30 years and they only have income if there doors are open and selling inventory that they have paid for.
