Last in education, first in excuses: NM loses millions after failing to spend funds

The Trump administration has taken a bold step to ensure accountability and fiscal responsibility in the handling of pandemic-era education relief funds—ending a previously granted extension for New Mexico to spend the remaining $12.3 million in federal ESSER (Elementary and Secondary School Emergency Relief) funds. In a March 28 letter, Linda McMahon of the U.S. Department of Education notified state education leaders that the liquidation period for these funds was being cut off effective immediately.

The decision came as a wake-up call to New Mexico’s education bureaucracy, which had failed to efficiently utilize its allotted federal aid. Despite being granted nearly $980 million in total relief through ESSER during the pandemic, New Mexico still had millions left unspent, with state officials citing supply chain issues and inadequate staffing. But McMahon’s letter made it clear: “By failing to meet the clear deadline in the regulation, you ran the risk that the [U.S. Department of Education] would deny your extension request.”

In other words, New Mexico had ample time to deploy these resources—yet, as with many government initiatives in the state, the follow-through was lacking.

Lieutenant Governor Howie Morales, a Democrat and former educator, reacted angrily, calling the decision a “reckless and abrupt termination” that would impact students across the state. He claimed it would disrupt after-school programs, HVAC upgrades, and even outdoor classroom projects—yet failed to address why these projects weren’t completed in the years prior.

Attorney General Raúl Torrez joined the chorus of complaints, calling the decision “unacceptable and reckless,” and announced that New Mexico was joining over a dozen other Democrat-run states in suing the Trump administration. The lawsuit alleges that the reversal would strip schools of “essential resources like food, classroom supplies, [and] special education for teachers.”

But what’s truly “unacceptable,” critics argue, is that Democrat Gov. Michelle Lujan Grisham’s New Mexico’s Public Education Department—despite being granted an extension through March 2026—still hadn’t managed to allocate the full amount efficiently. This is in a state that ranks dead last in education outcomes nationally, falling behind every other state and even the District of Columbia. According to longstanding rankings, New Mexico continues to struggle with low test scores, high dropout rates, and chronic absenteeism.

While the state now scrambles for another extension, the Department of Education has signaled that the era of open-ended pandemic spending is over. McMahon made it clear in her letter that “extending deadlines for COVID-related grants, which are in fact taxpayer funds, years after the COVID pandemic ended is not consistent with the Department’s priorities.”

The state had intended to funnel the remaining millions toward tutoring, after-school activities, and infrastructure upgrades in school districts, including Bloomfield, Deming, and Moriarty-Edgewood. However, the funds sat largely untouched despite the pressing academic needs brought on by the pandemic—another example, critics say, of bureaucratic mismanagement in a chronically underperforming education system.

Public Education Department spokesperson Janelle Taylor García confirmed the agency plans to apply for yet another extension. But with the Department of Education signaling that prior approvals are not guaranteed and “may be reconsidered,” the clock may have finally run out.

Despite the blow, Morales insists, “I’m not going to give up. I will continue to fight for our students and our educators who need these after-school, summer learning and tutoring programs.” Still, observers note that a true fight for students might start with taking responsibility for why the state fell behind in deploying resources in the first place—especially when the Trump administration is demanding that taxpayer dollars be used wisely and efficiently.

  1. Maybe we need to do a DOGE dive into our state’s finances, spending and agencies. I am certain we would find some real eye-opening areas that our money has been spent! Education is just an area that we are being graded nationally. And as you stated, last again as we have for many years.

  2. The main thing I noted done to the schools near me was the installation of new fences and gates – to either keep students in or parents out. What a waste…but that is typical of APS. They even locked up the on campus tennis courts so the public (including the police and fire station personnel across the street) could not use them. Funny how our tax dollars pay for APS, yet they believe everything belongs to them.

  4. The State of NM does not know how to manage money. This is a direct reflection of leadership who does not know how to lead. Failing to spend that amount of cash indicates that the Ed Department cannot be creative enough to find valid ways to spend that money to educate our children. So much could have been accomplished in the time they had to spend the money. This is also waste, just as much as MLG’s misappropriation of funds and power.

  6. You are all correct. But what are we going to do about it? Not that it makes a difference but I do attend community meetings and ask questions. I do receive emails from the elected officials in my area and reply (not sure they read them). I do ask folks what they think and try to get them interested in what is going on in our community. I ask others to do the same, as the more people learn what is going on the more they get pissed and want to get involved. I suggest we go back to reading writing and arithmetic and cut the BS wokeness out of schools. Maybe no sports until at least 1/2 the school reads ae grade level?? Yes that will get people interested in there kids

    1. Don’t waste you time with emails from elected officials, its all just a form letter saying thanks and really not answering questions. A waste of time. They all need to be voted out of office. All of MLG comrades and MLG needs to be removed from office. Impeachment or whatever else it takes to get her and her comrades out of the roundhouse.
      And that may include any Republicans that are rhinos who do not want to “make America great again!”

Where did the rest of the money go if NM students can’t read or write at even near grade level? Commie democrats are just scam after scam in every aspect of government therefore the dead last stats in every bad category. Then they fake indignation when they are called out or lose funding for incompetence!

  8. Management or rather Mismanagement is the key. NM ‘leaders’ (I use the term tongue in cheek) are so focused on their own little pet projects and doing what they need to do to get reelected. They do NOTHING to help New Mexico citizens, our children or seniors. NM has been MLGs own little fiefdom. Now she wants to be President??? Look at her track record before you vote for her ever again. NM has been a dem state for decades and most people just go with the flow. People here just look at the ‘name’ and NEVER look at policy or anything else. When we did get a Republican Gov in office, the rest of elected ‘Officials’ were dems and wouldn’t let her do ANYTHING good for the state. Heaven please help New Mexico.

  9. Explains why most of the schools put a hold on their Roofing projects they wanted to start; which does not make any sense. You would think they want to take care of their main assets, buildings. So Construction industry will feel the impact on this as well in already distraught economy.

  10. Education took a nosedive when the Superintendent of Education and the elected State School Board were abolished and politicized with a Governor-appointed Secretary of Education. This was a constitutional amendment that needs to be reversed. We desperately need stable (not a revolving door) and elected leadership (reflective of the local model) to get us out of this mess.

  11. New Mexico has 59 Billion Dollars in the Permanent Fund. That’s 59,000 million I really don’t think 12.5 million is a concern. New Mexico is a very wealthy State there is no reason we are last in everything.

    1. This is so true!!! It is is infuriating that NM has at least 23 billion in federal land grants, (maybe more). The interest earned off these grants is staggering! There is NO EXCUSE for NM to be LAST in EVERY category!!!

      New Mexico has been controlled by Dems for over 90 years. I’m sure they cheat every chance they get. It is truly pathetic that MLG, Keller, and all the other commies have totally destroyed this state of ONLY 2 million people. MLG wants to kill all the babies, and Tim Keller is letting ABQ be overtaken by homeless people and crime.

      Pretty soon there will be nothing left. Who will be able to live here?? Then what will they do??

  12. It seems that yes NM Gov’t is broken. BUT ask yourselves this, WHEN are voters going to actually going to have enough of all this and vote differently ? As we continue with the downward spiral into more democrats denial abut truths Nothing will change. Our state looks, functions, and reacts like a third world country now. My gosh, even the streets don’t get striped, or fixed. Basic necessities aren’t considered because the clowns running the show are NOT affected by the mess.
